The Supreme Court, whether they like it or not, are going to play a major role in the 2024 Presidential election and it could not come at a worse time.
The overturning of Roe vs Wade last year sent to confidence in the Court plummeting. This is evidenced by the subsequent state elections where abortion rights were on the ballot. Red state Kansas and Ohio are prime examples where abortion rights were protected.
The impartiality of the Court is under severe questioning. Scandals involving Clarence Thomas and the million in dollars of gifts that he has received together with his wife’s undisguised support of conspiracy theories has helped result in record low Gallop approval ratings.
Now the Court faces two major decisions. Is Trump immune from prosecution for actions taken during his Presidency? Can Trump be taken off the ballot due to the 14th Amendment definition of insurrection?
The Court had already passed off on the first decision by rejecting Jack Smith’s request for an immediate decision on the immunity question. It will have to go through the regular court process. But sooner or later it will go up to the Supreme Court where they will HAVE to decide.
The 14th Amendment question will have to be decided in early January. Colorado has to put in notice by January 5 who will be approved to be on the list of Republican Primary Candidates.
It is hard to imagine how the Court will push this question down the road. I would not want to be in any of their shoes right now.
