But, I digress. The US Constitution document states that,
“The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.”
The encyclopedia Britannica states that habeus corpus is,
“an ancient common-lawwrit, issued by a court or judge directing one who holds another in custody to produce the person before the court for some specified purpose. Although there have been and are many varieties of the writ, the most important is that used to correct violations of personal liberty by directing judicial inquiry into the legality of a detention.”
Essentially , the justice system must give evidenceas to why a person must be detained in jail. Stephen Miller is advising Donald Trump and Trump might act on it to suspend habeas corpus.
The woman, in the middle, is Rumeysa Ozturk. she is a 30-year-old student attending Tufts university. There’s a video of her being grabbed by mask men in the street and hauled away. These men were from ICE. They eventually transported her to a detention centre, in Louisiana, 1500 miles away. She was not convicted of any crime. Therefore, no justification was given as to why she was detained. A judge order to release yesterday.
Her detention came a year after she co-authored an op Ed in the Tufts university campus newspaper vocalizing her dislike at the university stance on the Gaza invasion by Israel.
As above, the constitution states that habeas corpus may be suspended in cases of rebellion or invasion. Neither of those two have occurred. Yet the White House is considering suspending habeas corpus. What is more chilling, is that only a couple days ago, Donald Trump stated and he did not know if he had to uphold the constitution.
If this does not scare the crap out of Americans, then you’re not understanding the assignment.
