Watched most of the Supreme Court hearing over Colorado wanted to remove Trump from the ballot. You could tell almost immediately that the Supreme Court was in no way going to approve. They focussed on two areas. First, whether the wording of the 14th Amendment included the President. The arguments revolved around the words elector and office. The justices were focusing on the technical aspects of these words.
The Justices also focused on practicality. If they approved the Colorado decision, what would stop other States from doing the same thing?
The third area that none of the Justices wanted to touch with a ten foot pole was the word ‘insurrection’ also in the 14th Amendment. There was no way they were going to get mired in it
In my opinion, without dividing the country, the Court took the only approach they could. I would not be surprised if it is a unanimous decision against Colorado.
Here is the good news though. The Court will soon have to decide whether Trump is entitled to immunity. I think it will be either a or close to a unanimous decision that Trump does not have immunity. One of the practical reasons will be if a President has full immunity, he/she could commit any crime without fear of prosecution.
What the Supreme Court will have done is split the baby in half and give both sides a win with their two decisions.
Well played Supreme Court.
