Chain Ramifications

An appeal court overturned Harvey Weinstein’s rape conviction in New York State yesterday. He is not a free man given that he is also in jail for rape convictions in California. However, the reason the conviction was overturned has serious ramifications for women who have gone through sexual abuse. The conviction was overturned because,

“the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts.”

This is a major setback for the metoo movement. What it could mean is that, in all future trials, a defendant’s past sexual history could not be introduced as evidence. Kind of unfair given that the plaintiff’s past history could still be fair game

This has ramifications for the current Trump hush money trial, as well. While the alleged crimes deal with payments made to Stormy Daniels, prosecutors have already covered Trump’s affair with Karen McDougal, no crimes involved, and have introduced the Access Hollywood tape (text of what Trump said). If Trump is found guilty, the conviction could be overturned, based on the Weinstein ruling. A sad day.
