More Bad News

Keeps getting worse and worse for Fox Entertainment. There was a two day hearing week, with both Dominion and Fox presenting arguments that the court should issue a summary judgement, without the need for a trial. Both sides lost, in that, there will be a trial held. But it goes downhill from there for Fox. This is part of Superior Court Judge Eric Davis’s ruling.

“The evidence developed in this civil proceeding demonstrates that is CRYSTAL clear than none of the Statements relating to Dominion about the 2020 election are true. Therefore, the Court will grant summary judgment in favor of Dominion on the element of falsity,”

Davis capitalized the word ‘CRYSTAL’. So, he did, in part, grant partial summary judgement to Dominion. As per Davis, a trial is required so that the jury can determine whether Fox made false claims (lied) with malice.

Fox has been claiming that they were just reporting what was news. They claim this even though Fox’s own entertainers, thought their frequent guests, Rudy and Sydney Powell, were nuts. Judge Davis stated the following,

“Even if the neutral report privilege did apply, the evidence does not support that FNN conducted good-faith, disinterested reporting,”

Davis also noted that,

“In fact, although it cannot be attributed directly to Fox’s statements, it is noteworthy that some Americans still believe the election was rigged,” 

Dominion is pushing their demands that Fox’s prime time entertainers such as Carlson and Hannity be required to testify at the trial. Dominion also wants Rupert Murdoch to testify, in part, so that they can use Murdoch’s own texts against him, such as the following text he made to Fox News CEO, Suzanne Scott.

“Maybe Sean and Laura went too far. All very well for Sean to tell you he was in despair about Trump but what did he tell his viewers?”

The trial will begin on April 17. I do hope that the judge will allow the trial will be televised live. If so, I wonder if Fox will carry it. Yeah, right.
